RE: May 31, 2002 e-mails; Responses from EPA:
" Hello,
I manage the Product Schedule that you visited at our Oil Program website.
"
I cannot reveal all of
the ingredients of Inipol EAP because
the company that submitted these data claimed some of the ingredients to be
Confidential Business Information. * A full MSDS can be obtained
from the company.
"U.S. Coast Guard was the leader of the Valdez spill response. You
should contact Captain Dave Westerholm in the Office of Response at
202-267-0518.
"Our office is not aware of any medical monitoring of workers in the
field that may have used the product you are asking about. The companies that
workers were employed by, Alaska state health departments, and OSHA may know
more about these medical records. If a company did the testing, then that
company should have the results.
Q: What does it take to be approved by EPA?
"The regulations that list the requirements to place products on the NCP Product Schedule are found in 40 Code of Federal Regulations Part 300.900 Subpart J. You can call 202-260-2342 and ask for a copy of them to be sent to you.
"EPA
requires all formulas to be revealed.
"EPA does not approve any products.
Q:
What is your position?
In lay terms, is it easy or difficult to be approved by EPA?
EPA: "I believe it is best to discontinue this type of communication since you may have a legal issue with some type of responsible parties in Alaska.
I cannot personally put myself into this matter without management direction.
"I have provided you with the source of information you requested on the Product Schedule.
"You will need to contact the Freedom of Information Office for further correspondence with EPA regarding this matter. Thank you for your cooperation.
Clarification from Washington D.C. Headquarters 6-20-02:
" A
listing on NCP Product Schedule is a prerequisite for a product to be considered
for use, but does not constitute "approval"

Wonder why EPA was so sensitive about being asked what it took to be on their approved list? ...when asked for all 4 (not just 2) ingredients of Inipol EAP 22 ...& also was it easy or hard to be on their approved list...? EPA response was: "request through the Freedom of Information Act!" |
